Landowner Detains Burglary Suspect

Two Clinton women were arrested and charged recently after allegedly attempting to steal items from a rural home north of Clinton.

The owner of the property would successfully detain one of the suspects before authorities arrived.

According to the probable cause affidavit, 39-year-old Amber Lynn Smith and 51-year-old Tina Ann Hall were arrested on December 7 after Custer County Sheriff’s Deputies were dispatched to the property after the landowner had discovered the two women attempting to take items from the property.

Authorities would find one suspect, Smith, fleeing the scene but would be pulled over a short time later near the Clinton Airport. Smith had allegedly left the second suspect, Hall, at the scene of the crime.

The court document would reveal that a search of the vehicle would find a clear glass pipe the deputy believed was used to smoke methamphetamine.

Later during the impound process for the vehicle the affidavit stated that authorities would find a license identifying the other woman, Hall, and a small green container with suspected marijuana inside.

Speaking with the property owner, she would tell authorities that when she arrived at the property she observed the car backed into the driveway of the home. There she would find Smith in the passenger seat of the car. After being confronted, Smith would allegedly exit the vehicle, get into the driver’s side, and drive off – leaving her accomplice behind who was still in the home.

The affidavit stated that Hall would come out of the home, where the property owner would detain her until the deputy arrived.

Both Hall and Smith were charged with second-degree burglary – a felony. Smith received a charge of possessing drug paraphernalia.
