Setting dumpsters on fire has landed a man a felony third degree arson charge in Custer County District Court.

According to a probable cause affidavit, 42-year-old Nicholas Minyong Rue of Clinton was charged on October 19 after court documents showed that on September 21, just after 2:30 a.m., a patrolling police officer observed a dumpster on fire directly behind a bank located in the 800 block of Gary Boulevard. The officer would also find a second dumpster on fire behind a separate business located in the 900 block of Gary Boulevard.

The next day an officer was able to obtain security video from the bank. There the officer observed a subject that she knows to be Rue from previous encounters, walk up to the dumpster and reach into it for a short period of time. The subject would the walk away towards the location of the second dumpster that caught fire that morning.

Shortly after, the video would show the dumpster on the security footage on fire.

An outstanding warrant for Rue was issued on October 19 as well. As of press time, Rue has not been arrested.

If convicted, Rue could face up to 15 years in jail along with a $10,000 fine.
